Banking Law

Shameela Chinoy has expertise in banking and financial services law in a number of areas including personal property security legislation, electronic commerce, privacy, and issues relating to the Canadian banking, payment and clearing systems. She offers consultancy services on specialised banking related issues.


Electronic Commerce

Shameela Chinoy was a member of the group reviewing draft uniform electronic commerce legislation that resulted in the Uniform Law Commissionerís Conference Model Uniform Electronic Commerce Act which was used by the federal government and the provinces in drafting electronic commerce legislation. In 2000, on behalf of the Canadian banks, Shameela Chinoy prepared a submission to the provincial government commenting on Ontarioís proposed draft electronic commerce legislation which resulted in certain necessary modifications to the law.



Shameela Chinoy has extensive experience with issues arising out of privacy legislation. In her role as legal counsel at the Canadian Bankers Association, Shameela Chinoy assisted member banks on several issues relating to the interpretation of federal privacy legislation (PIPEDA) and its application to banking activities.


          Transfer of Indirectly held Securities

As a member of the Production Committee, Shameela Chinoy has reviewed and commented on several drafts of The Hague PRIMA Convention, which was signed in December 2002 and the draft Uniform Securities Transfer Act and related amendments to the Personal Property Security Acts prepared and released in August 2003 by the Canadian Securities Administrators.


Canadian Depository for Securities

In her role as legal counsel at the Canadian Bankers Association, Shameela Chinoy was Secretary to CBA Committee for legal issues relating to clearing and settlement activities of the Canadian Depository for Securities and in this capacity she has reviewed and helped shape the rules for the new settlement system.


Cost of credit disclosure

Shameela Chinoy has reviewed and commented on the Cost of Credit Disclosure Template as well as monitored the passage of provincial Cost of Credit Disclosure legislation.


Associate Editor of the Banking and Finance Law Review

Concurrent with her other roles, since 1999 till present, Shameela Chinoy has been the Associate Editor of the Banking and Finance Law Review, the leading journal on banking law in Canada published by Carswell.


Payment, Clearing & Settlement in Canada, published by Canada Law Book

Shameela Chinoy has assisted Bradley Crawford Q.C. at McCarthy Tetrault with legal research for the present edition of the leading text on banking law - Payment, Clearing & Settlement in Canada, Volumes I & II published by Canada Law Book, 2002 and is presently working on the next edition.


Lecturer in Banking Law

In fall 2002, Shameela Chinoy lectured part-time at the Osgoode Hall Law School, York University where she taught at the LL.M Graduate Program the course Technological Innovation and Competition in Banking Law and prepared the course material modules to be electronically delivered to students on-line.


Shameela Chinoy has been a part-time professor and lecturer in banking law for the Bachelor of Laws program at the University of Toronto,  ] and is presently teaching the law of banking and negotiable instruments  at the Bachelor of Laws program at the Osgoode Hall Law School of York University


Financial Services Commission (FSCO)
Shameela Chinoy can assist lenders and mortgage brokers in regard to compliance and regulatory issues related to the Ontario Mortgage Brokers Act in matters before the Financial Services Commission (FSCO) in Ontario.
